| (1) Certain shippers will not be eligible for the rate discount, pursuant to Section
2.5 of the Stipulation and Agreement contained in the Offer of Settlement filed by
Paiute in FERC Docket No. RP05-163-000, et al., on October 21, 2005.
Among such shippers are those firm shippers that terminate or reduce their daily contract entitlement on or after August 1, 2005. Those shippers, and the effective date of their ineligibility, are as follows: EP Minerals, LLC 2-28-06 United Engine & Machine Co. 2-28-06 Winnemucca Farms, Inc. 2-28-07 A firm shipper who releases capacity to any of the above shippers after the effective date of their ineligibility is also ineligible for the rate discount for the duration of the release. |
