(1) Certain shippers will not be eligible for the rate discount, pursuant to Section
2.5 of the Stipulation and Agreement contained in the Offer of Settlement filed by
Paiute in FERC Docket No. RP09-406-000, et al., on November 3, 2009.
Among such shippers are any firm shippers that terminate or reduce their daily
contract entitlement on or after September 1, 2009. Currently, all shippers are eligible for the rate discount.
Under certain circumstances, as described in Section 2.5 of the Stipulation and Agreement, a firm shipper
who releases capacity to an ineligible shipper after the effective date of its ineligibility may also
be ineligible for the rate discount for the duration of the release.
